As a result, you on behalf of yourself and your family, hereby release, covenant not to sue, discharge, and hold harmless Westgate, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. Qualifications for Resort Preview Packages:
This offer is open to US citizens who are married, engaged, cohabiting, or a single female (not separated) who are gainfully employed with a verified yearly household income of $50,000 (or $60,000 for Las Vegas) and a FICO score of 600 or higher. If engaged, one must qualify as a single but both parties must tour together. Income is defined as “annual gross income before taxes” and excludes income from unemployment, workers compensation, alimony, child support, temporary disability, home-based daycare or salon businesses, real estate agent earnings, rental properties, shares, bonds, annuities, commissions, and tips. Self-employed guests require proof of business ownership such as a business card, business license, business credit card or a business website (social media pages are not accepted), even if the partner has a job that covers the income minimum.
For qualified couples traveling to Branson, Cocoa Beach, Orlando, and Williamsburg, one must be 25 to 70 years of age; the other may be younger than 25. For qualified couples traveling to Gatlinburg, Myrtle Beach, and Las Vegas, both must be 27 to 70 years of age. Single females traveling to all locations must be 28 to 70 years of age. All couples must attend the 90-minute discovery tour and sales presentation together following breakfast at Westgate Resorts. Single females, if applicable, must attend the presentation with their fiancé, boyfriend, girlfriend, or partner. Married and cohabiting couples must provide proof of matching addresses by presenting a valid driver’s license or state identification card. Participants must have a valid credit card in their name to hold the resort security deposit and taxes upon check-in; pre-paid or reloadable cards do not qualify. Guests traveling to Branson, Cocoa Beach, Gatlinburg, and Orlando must speak and understand English or Spanish fluently (English only in Branson and Williamsburg).
Subject to qualifications, this Offer is available to citizens of the United States and in countries where registered. This offer is not available to past or current Westgate employees and their immediate families including stepparents and stepchildren, Westgate timeshare owners, boyfriends / girlfriend of owners unless traveling with the owner, Westgate Vacation Ownership (“VOA”) owners, individuals employed in the timeshare industry, realtors, persons residing within 60 miles of the resort, guests who are scheduled for any other tour with Westgate during their stay, persons who have received the vacation package as a gift from a second party, group travel (three or more couples or singles traveling together on separate packages), anyone attending or participating in a sporting event, convention, family reunion, wedding, bachelorette / bachelor party, birthday party, children or parents of Westgate owners, persons who have toured any Westgate Resort location within the last six (6) months or have participated in a Westgate discounted promotional offer requiring a tour more than twice in a lifetime, persons who have previously been considered not qualified based on Westgate’s qualifications, persons consuming alcohol or are under the influence of alcohol or controlled substances, or persons who exercise socially unacceptable behavior including but not limited to screaming, profanity, advances, verbally or physically threating any persons. Failure to qualify and attend and complete the sales presentation will result in a surcharge of up to $500.00 or the rental rate, whichever is greater, plus the retail rate of any discount attraction tickets that are included in the vacation package. Current Westgate owners may qualify for certain promotions if the above criteria have been met and their account is in good standing. The minimum requirement may be higher, and other qualifications may vary based on destination and travel season. This Offer is not considered free travel. Travel must be within six (6) months from the date of purchase or as otherwise stated in the Offer.
Westgate Event Series:
To qualify for the Westgate Event Series program, owner(s) are required to have owned with Westgate a minimum of six months, the account must be in good standing, and the owner must be gainfully employed. Owners are required to travel with all individuals listed on their deed and be accompanied by a qualified referral, excluding parents and children of the owner(s). Participants in the cruise events must adhere to current cruise line terms and conditions in which the participant is traveling. Cruise participants must travel with a valid passport, subject to terms and conditions set by the cruise line. The Westgate Event Series packages are non-refundable, including any and all tickets or vouchers once issued by Westgate. By attending a Westgate Premier Event, you consent to your voice, name, and/or likeness being used, without compensation, in print, film, and tape for exploitation in any and all media, whether now known or hereafter devised, for eternity, and you release Westgate Resorts, Ltd., its successors, assigns, and licensees from any liability whatsoever of any nature. Failure to qualify and attend and complete the sales presentation will result in a surcharge of up to $500.00 or the rental rate, whichever is greater, plus the retail rate of any discount attraction tickets that are included in the vacation package. Special Notice: If fewer than 15 packages are sold, the welcome party and transportation will be replaced with $75 resort dining credit and $40 transportation credit.
Accommodations:
Price shown is good for two (2) adults and up to two (2) children, under the age of eighteen (18), in a studio villa or hotel room during value season, unless otherwise noted. Reservations are first-come, first-served, based upon availability and inventory. Travel during peak season, holidays, and special events is subject to a surcharge. Additional nights, larger units, and discounted attraction tickets are available. Due to safety and fire code regulations, there is a maximum occupancy limit set for every room at any of our resort locations. This occupancy number limit is based on state and federal regulations regarding the size and space of each room. Every person, regardless of age, is considered as one (1) person and is counted towards the maximum occupancy limit of persons for that room and location. Accommodations provided by Central Florida Investments (CFI) and Westgate Resorts, Ltd. Alternate accommodations may be used if Westgate Resorts is not available.
Cancellation / Date Change / Extension / Reinstatement Policy:
Vacation packages purchased over the phone or in person with no selected travel dates have a cancellation period of 30 days from the date of purchase. Vacation packages purchased with selected travel dates have a cancellation period of 14 days from the date of purchase. However, all Westgate Event Series packages are non-refundable. Travel date cancellations or date changes within 7 days of arrival are subject to a $25 service fee. Travel date cancellations or date changes within 72 hours of arrival are subject to a $25 service fee and a one-night non-promotional room charge. If the guest is unable to travel prior to the expiration date of the Offer, the guest may extend the expiration date by 3 months for a $25 fee or 6 months for a $50 fee. You can reinstate expired packages for a $50 fee, plus an additional $25 for 3 months or $50 for 6 months.
This Offer is non-transferable and is not valid in conjunction with any other promotion. Limit one (1) per household. Blackout dates may apply as defined by Westgate Resorts in its sole and absolute discretion. Certain holidays and peak dates require owner sponsorship. Offer not available to persons who are in the process of bankruptcy or parents/children of owners. Travel is not available for singles to an Orlando property during holiday season or for singles from Florida or Georgia to an Orlando property during peak season. ARBITRATION OF DISPUTE:
IMPORTANT NOTICE AFFECTING YOUR RIGHTS: THIS OFFER IS GOVERNED BY THE LAWS OF USA AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. Venue for any action arising hereunder shall exclusively lie in Orange County, Florida. In the event of any controversy between the parties, including but not limited to any claim, dispute, suit, demand, cross claim, counterclaim, or third-party complaint (whether statutory, in tort or otherwise) arising out of or relating to WOW Loyalty Program and the interpretation or validity of these Terms, including the validity, scope or applicability of this arbitration provision (also “Agreement”), shall be determined by binding arbitration. This arbitration provision is governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. § 1 et seq. and not by any state rule or statute governing arbitration. THE PARTIES AGREE THAT ARBITRATION SHALL BE HEARD BY A SINGLE ARBITRATOR. YOUR CLAIM WILL NOT BE BROUGHT IN COURT AND NEITHER A JUDGE NOR A JURY WILL HEAR YOUR CLAIM. Arbitration shall be administered according to the arbitration service’s commercial arbitration fee schedule and the service’s current commercial rules and procedures except that: 1) the parties expressly waive the applicability of any rule governing class, collective or mass action; and 2) the parties agree that any specific arbitration procedure provided for herein shall apply to the arbitration proceeding. The arbitrator shall be neutral and independent and shall comply with the selected arbitration service’s code of ethics. Additionally, the arbitrator shall be guided by and apply the Federal Rules of Evidence and “governing substantive” law. The arbitrator’s award shall be final and binding on all parties, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards. Judgment on the arbitration award may be entered in any court having jurisdiction over the parties. If a party fails to comply with the arbitrator’s award, the other party may petition a court having jurisdiction to enforce the award.
Notwithstanding the above, YOU MAY CHOOSE TO PURSUE A FUTURE CLAIM IN COURT AND NOT BY ARBITRATION IF YOU OPT OUT OF THESE ARBITRATION PROCEDURES WITHIN 45 DAYS FROM THE DATE OF ENTERING THE WOW LOYALTY PROGRAM. You may opt out of these arbitration procedures by calling (844) 311-6211 or via the internet by completing the opt-out form located at www.westgateoptoutform.com. Any opt out received after the opt-out deadline will not be valid and you must pursue your claim in arbitration. Whether you accept this arbitration agreement or opt out of arbitration so you can proceed in court, you acknowledge and agree that, in any court case you may file, you WAIVE THE RIGHT TO A TRIAL BY JURY AND THAT YOU CANNOT FILE A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE OR MASS ACTION OR PARTICIPATE IN A CLASS ACTION.
Rental Reservations:
Prices listed are initial costs for each vacation package in US dollars and are subject to availability when booking. Tips and taxes are not part of the rates, and the prices may change without prior notice. Blackout dates, length of stay restrictions, and seasonal surcharges may apply. Offer cannot be combined with other promotions or special deals, and they cannot be used for group purchases. In the rare case that the reserved hotel is not available due to overbooking or unexpected circumstances, a hotel of equivalent or higher quality may be substituted.
Security / Incidental Deposit:
At all Westgate properties, excluding Las Vegas, a $100 credit card hold will be authorized for incidentals and a security deposit. In Las Vegas, a $50 per night credit card hold is required, not to exceed $200 total.
Ticket / Gifting Policy:
To redeem your ticket or ticket voucher, you will need to present the credit card used at the time of purchase and a valid driver's license. All tickets and vouchers are non-refundable once issued by Westgate, including Westgate Event Series tickets. You may not be eligible for all premiums offered in this promotion. Tickets are sold based on room occupancy, and Westgate reserves the right to substitute gifts, tickets, and ticket vouchers with comparable items of equal or greater value. Ticket and gifting prices are subject to change without notice.
Tour Policy:
Westgate reserves the right to modify the tour date, tour time, and/or location without notice to the end user. The tour date and/or tour time cannot be changed by the guest(s) within two weeks of their check-in date. A tour cannot be booked on the guest’s arrival date or departure date. Two tours are allowed in guest’s lifetime, participant can tour a different resort 6 months from the first tour date, 12 months from originally tour date if touring the same destination as the first tour. Failure to qualify for the tour or no show to the tour will result in a $500 no tour fee.
Dog Friendly Policy:
Unless otherwise stated, most Westgate Resort locations are dog friendly. Please note that no other animal types are permitted on any Westgate property and is strictly enforced for the safety and enjoyment of all guests. Westgate Resorts will allow up to two (2) dogs per room/suite as “pets”. A dog must not exceed 60 pounds, or in the case of 2 dogs, they must not exceed 60 pounds combined. Height and length restrictions apply, dogs can be no longer than 36 inches and no taller than 36 inches. A mandatory, non-refundable cleaning fee of $150 will be charged upon check in for dogs reported to Front Desk. An additional $100 penalty will be charged for dogs unreported and found in the room/suite. While the dog is in the room/suite, it is required to be supervised by the guest or always crated. At the time when Housekeeping services are provided, housekeeping will not service the room/suite if the dog is left unattended or is not properly crated. When the dog is out of the room/suite and on property, the dog is required to be on a leash and under the control of the handler. In the event the dog damages, soils/stains fabric or carpet beyond normal cleaning, additional charges will be assessed. Dog Relief Areas may be provided for the guest convenience. If not, guests are expected to take their dogs outside of the property’s public areas for any relief. Dogs will not be permitted in any guest public areas for relief. The handler is required to pick up and properly dispose of any dog deposits in the dog relief area. It is the guest’s responsibility to confirm with the Front Desk as to the locations outside of the guest’s room/suite where the dog is permitted. A dog is not allowed in public areas, including but not limited to restaurants, spa/salon, pool areas, showrooms, convention spaces, casino, and/or common retail spaces. Certain dog breeds have a reputation for being more aggressive than others. For the safety of all guests, these breeds are not allowed on property. Dog breeds may include, but are not limited to: Great Dane, Sharpei, Pit Bull, Rottweiler, German Shepherd, Husky, Alaskan Malamute, Doberman Pinscher, Chow Chow and Presa Canario (other dog breeds at discretion of Management). Any dog, regardless of breed, who shows aggression will be asked to be removed from the property. A dog will not be permitted to disturb other guests. Aggressive behavior, even for breeds not listed as a Non-Permitted Dog Breed, will not be permitted to stay on property. Excessive barking will result in the owner of the pet needing to find proper accommodations for their dog, not on Westgate premises. Any restrictions set forth herein including limitations on size, breed, or number of dogs an individual can have or a location where a dog can be present with its owner or handler referenced herein only apply to pets and not service animals. Failure to comply with any and all items stated within the Dog Friendly Policy will result in the requirement for the guest to immediately remove any pet from the resort, up to and including immediate cancelation of reservation and forfeiture of Security Deposit. Furthermore, all penalty policies under the Westgate Resorts Terms & Conditions will apply.
Service Animal Policy:
Service animals are permitted with strict pre-authorization from resort management. Emotional support animals are not considered service animals under ADA titles I and II and will not be permitted. Dogs and certain miniature horses (height 24-34 inches, weight between 70 & 100 pounds) are eligible to be recognized as service animals under Titles II and III of the ADA. A service animal is a dog or a miniature horse that is individually trained to do work or perform tasks for the benefit of a person with a disability. Examples of such work or tasks include guiding people who are visually impaired, alerting people who have hearing loss or are considered deaf, pulling a wheelchair, alerting, or protecting a person having a seizure, reminding a person with mental illness to take prescribed medications, calming a person with Post Traumatic Stress Disorder (PTSD) during an anxiety attack, or performing other duties. Service animals are working animals, not pets. The work or task a service animal has been trained to provide must be directly related to the person’s disability. Animals whose sole function is to provide comfort or emotional support may not qualify as service animals under the ADA. Generally, Title II and Title III entities must permit service animals to accompany people with disabilities in all areas where members of the public are normally allowed to go. For example, in the hotel it would be inappropriate to exclude a service animal from common areas such as dining rooms. However, it may be appropriate to exclude a service animal from kitchen areas where the animal’s presence may compromise a sanitary environment for food preparation. Under the ADA, service animals must be harnessed, leashed, or tethered, unless these devices interfere with the service animal’s work or the individual’s disability prevents these devices. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls. When it is not obvious what service an animal provides, only limited inquiries are allowed. Team members may ask two questions: (a) is the dog/miniature horse a service animal required because of a disability? and (b) what work or task has the dog/miniature horse been trained to perform? Team Members cannot ask about the person’s disability, require medical documentation, require a special identification card or training documentation for the service animal, or ask that the service animal demonstrate its ability to perform the work or task. Also, when the animal’s service is open and obvious, a Team Member should refrain from any inquiry. A person with a disability cannot be asked to remove the service animal from property unless: (a) The service animal is out of control and the handler does not take effective action to control it. (b) When it is determined that the animal’s behavior poses a direct threat to the health or safety of others. (c) The service animal is not housebroken. When there is a legitimate reason to ask that a service animal be removed, team members must offer the person with the disability the opportunity to obtain the goods or services without the animal’s presence. The mandatory cleaning fee is waived for service animals. Damage caused by a person with a disability, or their service animal will be charged according to the hotel’s standard procedures. Team Members are not required to provide care or food for a service animal.
Smoking / Drug-Free Zone Policy:
All rooms are non-smoking. Any guests found to have smoked, vaped, or used an e-cigarette within the room will be charged an additional cleaning fee. Regardless of state legalization legislation for either recreational or medical use, all resorts are private property and considered drug-free zones, which means that the use or possession of illegal narcotics and/or marijuana on resort grounds is not permitted. Infractions of this policy may result in trespassing penalties under applicable laws. This policy is relevant to all properties owned and operated by Westgate Resorts. Westgate expects all guests and visitors to comply with all provisions of this policy. Where Federal and/or State law or rules differ, the company will abide by the applicable standard.
Weapons Policy:
Resort premises are private property. The safety and security of our guests, visitors, vendors, and associates are of utmost importance to Westgate Resorts. This policy is designed for the protection of our guests, visitors, vendors, and associates and pertains to the presence of weapons on premises owned and/or operated by Westgate Resorts. No weapons, including firearms, knives, and explosives, are allowed on Westgate Resorts' premises, regardless of whether they are concealed or not, and regardless of any permits, except as explicitly stated. Westgate Resorts reserves the right to determine, in its sole and absolute discretion, what constitutes a weapon. On-duty state and federal law enforcement officers with jurisdiction, as well as military personnel, are permitted to carry any weapon. Resort associates may carry a weapon with express written permission or as part of their assigned duties. Shotguns are permitted at Westgate River Ranch Resort for the sole and express use at the Trap & Skeet Range. All individuals who possess a weapon on premises, whether permitted or not, must comply with all applicable federal, state, and local laws regarding that weapon. Persons found to be in violation of this policy may be subject to applicable trespass laws. This policy applies to all Westgate Resorts' owned and operated properties. The company expects that these individuals will comply with all provisions of this policy. Where federal and/or state law or rules differ, the company will abide by the applicable standard.
Taxes and Fees:
The guest is responsible for any and all taxes, fees, other government and/or airport-imposed charges and fees incurred before, during, or after their stay, including but not limited to tips, gratuities, meals, beverages, alcohol, and/or transportation costs except transportation to Westgate Event Series packages and Cruise Owner Event packages; Transportation to and from port will be provided by Westgate Resorts' or an affiliated transportation company.
Resort Fee Policy:
Westgate Resorts provides certain services and activities at each resort that are sure to enhance your experience at the resort. Purchaser is responsible for the following for any and all Resorts fees, if applicable. A $(14.99-39.99) Nightly Resort fee, plus applicable tax, is applied to each hotel reservation that is NOT associated with a Resort Preview (sales presentation) The Nightly Resort Fee includes the following resort services: Westgate Vacation Villas/Town Center: $24.99 + tax Wi-Fi, Local Calls, Fitness Center, In-Room Safe, Sports Courts Access & Sports Equipment, Mini-Golf, Bike Rentals, Movie Theater Access and Boarding Pass Printing. Westgate Lakes Resort & Spa: $21.99 + tax Wi-Fi, Local Calls, Fitness Center, In-Room Safe, Sports Courts Access & Sports Equipment, Mini-Golf, Bike Rentals and Boarding Pass Printing. Westgate Palace Resort: $21.99 + tax Wi-Fi, Local Calls, Fitness Center, In-Room Safe, Sports Courts Access & Sports Equipment, Paddle Boat, Movie Theater Access, and Boarding Pass Printing. Westgate Blue Tree Resort: $14.99 + tax Wi-Fi, Local Calls, Fitness Center, In-Room Safe, Sports Courts Access & Sports Equipment, Mini-Golf, Board Games and Boarding Pass Printing.
